1. Acceptance of Terms

These Terms and Conditions govern access to and use of OnSight, including our website, admin dashboard, mobile application, APIs, support channels, and related services.

By creating an account, using OnSight, inviting users, submitting data, or accessing the service on behalf of an organization, you agree to these Terms. If you use OnSight for an organization, you represent that you are authorized to bind that organization.

2. The OnSight Service

OnSight provides workforce intelligence and compliance tools for distributed teams, including geofenced attendance, worksite assignment, check-ins, check-outs, auto check-in, live workforce visibility, exception management, audit logs, reporting, exports, subscription controls, device trust, identity verification, and AI-assisted operational insights.

Available features may depend on subscription tier, organization configuration, mobile app permissions, device capabilities, region, and third-party service availability.

3. Customer Responsibilities

Organizations using OnSight are responsible for lawful and appropriate use of the platform.

  • Configure working hours, geofences, primary worksites, team assignments, check-in policies, retention settings, device trust settings, and AI features accurately.
  • Provide required notices, obtain required consents, and comply with employment, privacy, labor, monitoring, biometric, data protection, and workplace laws that apply to their users.
  • Ensure administrators have appropriate roles and permissions, protect credentials, enforce MFA where required, and promptly remove access for users who should no longer have access.
  • Review AI-assisted insights, exception signals, fraud signals, and analytics before making employment, disciplinary, payroll, compliance, or operational decisions.

4. Employee and Mobile User Responsibilities

Users must use OnSight honestly and only for authorized work-related purposes.

  • Do not share accounts, allow buddy punching, submit false attendance records, spoof GPS, tamper with device integrity signals, or use unauthorized tools to bypass geofences.
  • Use approved devices where required by company policy and submit accurate check-in reasons, exception notes, selfies, and worksite selections.
  • Maintain required app permissions, including location and notification permissions, where your employer has configured those features.

5. Accounts, Security, and Admin Access

You are responsible for keeping account credentials secure and for all activity under your account. You must notify us promptly if you suspect unauthorized access.

OnSight may require MFA, email verification, device approval, biometric approval, or other security checks for certain workflows. We may suspend access if we detect security risk, abuse, non-payment, or violations of these Terms.

6. Data, Privacy, and Auditability

Our Privacy Policy explains how we collect, use, and protect information. Customer data remains subject to the customer's lawful instructions, subscription configuration, and applicable agreements.

OnSight may create append-only audit logs and security records for compliance, accountability, abuse prevention, and platform integrity. Customers are responsible for reviewing audit records and managing internal access controls.

7. AI-Assisted Features

OnSight may provide AI-assisted summaries, risk signals, recommendations, briefings, exception analysis, or compliance insights. AI outputs are provided to support human review and should not be treated as legal advice, HR advice, payroll advice, or a final employment decision.

Customers are responsible for validating AI outputs, correcting inaccurate data, and ensuring fair and lawful use of AI-assisted features.

8. Payments, Plans, and Subscription Limits

Subscription fees, plan limits, included features, usage caps, billing periods, trial periods, add-ons, and export availability may vary by plan. Payment processing may be handled by Paystack or another payment provider.

Unless required by law or stated in an order form, fees are billed in advance and are non-refundable. Failure to pay may result in downgrade, suspension, or termination of access.

9. Acceptable Use

You must not misuse OnSight or interfere with platform integrity.

  • Do not use OnSight for unlawful, harmful, deceptive, discriminatory, or unauthorized monitoring purposes.
  • Do not attempt to access another organization's data, reverse engineer the service, probe infrastructure, overload systems, bypass rate limits, or compromise security controls.
  • Do not upload malicious code, unlawful content, or content that infringes third-party rights.

10. Third-Party Services

OnSight relies on third-party providers for infrastructure, maps, geocoding, payments, email, anti-abuse protection, observability, AI infrastructure, and app distribution. Their services may be subject to their own terms and availability.

11. Availability and Changes

We work to keep OnSight reliable, but the service may be unavailable during maintenance, upgrades, outages, security events, third-party failures, or circumstances outside our control.

We may add, change, suspend, or remove features, pricing, limits, integrations, or policies. Where changes materially affect active customers, we will provide reasonable notice where practical.

12. Intellectual Property

OnSight, our software, designs, content, workflows, branding, and platform technology are owned by OnSight or our licensors. Customers retain rights to their own data, subject to the rights needed for OnSight to provide and improve the service.

13. Disclaimers and Limitation of Liability

OnSight is provided on an as-is and as-available basis to the fullest extent permitted by law. We do not guarantee that every location, device integrity, AI, fraud, or exception signal will be complete, accurate, or uninterrupted.

To the fullest extent permitted by law, OnSight will not be liable for indirect, incidental, special, consequential, punitive, or lost-profit damages arising from use of the service.

14. Termination

You may stop using OnSight at any time. We may suspend or terminate access if you violate these Terms, fail to pay, create security risk, or use the service unlawfully. Termination does not remove payment obligations already incurred or audit records we are required to retain.

15. Governing Law and Disputes

The governing law and dispute process may be stated in an applicable order form or written agreement. If no separate agreement applies, disputes will be handled under the laws applicable to the OnSight contracting entity, except where mandatory law provides otherwise.
